A practitioner’s client will occasionally be required to provide a statutory declaration, which as we know must be signed in the presence of an “authorised witness”. Certain professions are authorised under the legislation to act as an authorised witness for statutory declarations under the governing authority, the Federal Attorney-General’s Department. However members of certain professional organisations may also be on the list of authorised witnesses (a thorough list of authorised witnesses is available on the Attorney-General’s website).
Examples include members of the Institute of Chartered Accountants in Australia, the Australian Society of Certified Practising Accountants, the Institute of Public Accountants, Association of Taxation and Management Accountants, and Fellows of the National Tax Accountants’ Association.
At present, members of Tax & Super Australia (TSA), or fellows of TSA’s affiliate Registered Tax Agent Association (RTAA) TAI Practitioner & Advisors Ltd, are not authorised to act as an authorised witness.
This may be about to change.
TSA has approached the appropriate government body to secure authority for its RTAA members to be able to officially act as authorised witnesses for their client’s (or for any person’s) statutory declarations.
We will keep members informed of the progress of this initiative as information comes to hand. In the meantime, see the poll at right. It will be helpful if we can have the information gathered from this poll to bolster our push to be granted this authorisation.
